Telecommunications law requires extensive, detailed knowledge of Danish law and EU law and technical aspects. We have extensive expertise in this area due to our provision of advice to both large operators, providers and potential actors.

We also provide assistance in connection with various joint ventures and acquisitions in the telecommunications sector and the procurement of various licences.

Our advice consists of, among other things:

  • peering and roaming
  • licence requirements and procurement of licences
  • requirements to suppliers of telecommunications services, including Internet Service Providers (ISPs)
  • drafting of relevant agreements.

To this should be added assistance in connection with negotiations with relevant authorities such as the Danish National IT and Telecom Agency as well as dispute resolution.

Rights to content on the internet

IT, telecommunications and media increasingly merge and therefore it is important to possess thorough knowledge of all three areas when advising on telecommunications. Rights to content (and payment for use of such content) on the internet is an important area for operators and providers of telecommunications services which may imply obligations but may also provide a number of possibilities of obtaining alternative earnings. An example is the Pirate Bay case where Plesner assisted Tele2 (Telenor) in connection with a notification from IFPI on closing of the company's internet customers' access to the Pirate Bay website.
