Public employees

The requirements to be met by the public and the semi-public labour market have changed and the public sector is increasingly required to be able to function on the terms and conditions of the private labour market.

Labour and employment law in the public sector is also complex as it is governed by public law and collective and individual agreements.

We provide advice on employment issues to public undertakings and institutions and we ensure that the public workplace is able to navigate its way through the applicable sets of rules. We also provide advice on, for example:

  • statutory authority
  • the principle of equality before the law
  • consultation processes
  • proportionality
  • the duty to take notes
  • "skøn under regel" (a Danish public law rule)
  • duty of confidentiality
  • the statutory rules applying to civil servants
  • business transfers, including outsourcing
