Litigation and arbitration

The considerable part of Plesner's work is formed by dispute resolution.

Arbitration

We have vast experience in Danish and international arbitration proceedings. We frequently represent one of the parties but we also act as arbitrators appointed by either one of the parties or by an arbitration institution, including as the presiding judge for the arbitration court.

We regularly conduct cases before the Danish Institute of Arbitration, the Danish Building and Construction Arbitration Board and before ad hoc arbitration tribunals, Danish as well as international.

Extensive litigation experience

All of our attorneys are experienced litigators. Through the years a number of our experienced attorneys have conducted a large number of proceedings before the Danish Supreme Court, the Danish High Courts and the Maritime and Commercial Court in Copenhagen, both legal proceedings in specific practice areas such as IP Law, Insurance Law, Tort Law, Construction Law and Tax Law, but also legal proceedings of a general nature.

As regards European Community law we have significant litigation experience in cases before the European Courts of Justice, both in cases directly before the Court of First Instance and the Court of Justice and references of preliminary questions to the Court.

Communication work, positions of trust, etc.

A number of our attorneys participate in preparatory legislative work regarding the administration of justice; they teach procedural law at the university, they teach at various courses and they publish articles. We also have representatives on the board of Højesteretsskranken (a Danish association of experienced Supreme Court litigators), on the board of Dansk Forening for Voldgift (the Danish Arbitration Association) and on the Danish Appeals Permission Board.

High-profile cases

  • the AMBI case regarding special contribution to the labour market fund (also before the European Court of Justice)
  • the Faroe Bank case (investigation)
  • the bridge between the two Danish islands Zealand and Funen, Storebæltsbroen (construction law)
  • Hafnia (prospectus responsibility)
  • the Bank of Himmerland case (tax)
  • the landworks of the Sound connection (construction law)
  • Novo's share options (tax)
  • the Maastricht Treaty (the referendum)
  • the case regarding the Port of Copenhagen (ownership)

Legal inquiries

We undertake legal inquiries at the request of public authorities as well as private undertakings. In connection with inquiries we also participate as assessor to the persons in question.

Mediation

Mediation is used increasingly and it is an alternative opportunity to resolve disputes. Read more about our competences in this area under Mediation.

Chambers Europe (2011)

"Dispute resolution is one of this firm's key strengths. The team has sound experience acting before international and domestic courts, with many of the lawyers holding positions on international dispute resolution associations. While the group covers a wide range of sectors including tax, IT and insolvency, commentators report that it is especially 'solid in insurance and construction disputes'."
